1. Introduction
Welcome to JobWinner, accessible at www.jobwinner.ai and through any related applications, subdomains, or white-label portals (the “Platform”). These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and JobWinner.ai (“JobWinner,” “we,” “our,” or “us”).
These Terms apply exclusively to Users who access the Platform through an Organization-provided version of JobWinner, including white-label or institution-specific portals.
By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, Cookie Policy, Service Level Agreement, and any additional guidelines, policies, or agreements that may apply.
If you do not agree to these Terms, you must immediately discontinue use of the Services.
These Terms of Service are issued by JobWinner Ventures Limited, a company incorporated and existing under the laws of Ireland, with registered office at:

For the purposes of these Terms, the following definitions apply:
“Platform” refers to the JobWinner website, subdomains, Organization-branded versions, and any other interfaces through which JobWinner provides its Services.
“Services” refers to all tools and functionalities offered through the Platform, including AI-powered CV tailoring, cover letter generation, interview preparation, job-match insights, and employability support features.
“User,” “you,” “job seeker” or “your” refers to any individual who accesses or uses the Platform under these Terms because their access is provided by an Organization.
“Organization” refers to any university, bootcamp, training provider, coaching business, or other entity that has a service agreement with JobWinner to provide Platform access to Job Seekers or Organization Members.
“Organization Members” refers to advisors, coaches, mentors, staff, administrators, or employees of an Organization who use the Platform to support Job Seekers or manage the Organization’s use of JobWinner.
“Organization Dashboard” refers to the administrative interface through which Organization Members support Job Seekers and access Organization-level features provided by JobWinner.
“Organization-Provided Version” refers to any instance of JobWinner branded, customized, or offered under a white-label or institution-specific domain.
2. Scope of Services
2.1 Overview of JobWinner’s Services
JobWinner provides Job Seekers and Organization Members with access to AI-powered tools designed to support employability, job-application quality, and career readiness. The Services may include CV tailoring, cover-letter generation, job-match analysis, skills insights, interview preparation tools and other functionalities made available through the Platform.
2.2 Use of the Platform by Job Seekers
Job Seekers may use the Platform to create or improve application documents, analyze job descriptions, review skills alignment, prepare for interviews, and access employability insights. These tools are intended to support career development, and the accuracy or suitability of any AI-generated content must be reviewed by the Job Seeker before use.
2.3 Use of the Platform by Organization Members
Organization Members may use the Platform to access dashboards, review usage insights, support Job Seekers in their application processes, configure Organization-level settings, or assign resources and training materials.
Organization Members act under the sole responsibility of their Organization. JobWinner is not responsible for any guidance, advice, decisions, or actions performed by Organization Members when supporting Job Seekers

2.4 Availability of Services
JobWinner strives to provide reliable and continuous access to the Platform. However, uninterrupted availability cannot be guaranteed. Temporary disruptions may occur due to maintenance, updates, technical issues, or factors outside JobWinner’s control. These interruptions are considered acceptable within the reasonable operation of online services.
2.5 Changes to Functionality
JobWinner may modify, improve, limit, suspend, or discontinue certain features, tools, or sections of the Platform at any time. No User is entitled to the continued availability of any specific functionality, service tier, or interface.

2.6 Content Storage and Access
The Platform is not intended to serve as a permanent archive or long-term storage system. JobWinner does not guarantee the permanent availability of documents, files, or content uploaded or generated on the Platform.
2.7 Removal of Content
JobWinner may remove, block, or restrict access to Content that violates these Terms, applicable law, or organizational policies, or where required by legal authorities or third-party rights holders.
3. Eligibility
3.1 Age Requirement. You must be at least 16 years old to create an Account or use the Services. Users under the age of 18 may only use the Services with consent and supervision of a parent or guardian.
3.2 Capacity. By using the Services, you represent that you have the legal capacity to enter into binding agreements. If you are accessing the Services on behalf of an organisation, you warrant that you are authorised to accept these Terms on its behalf.
3.3 Geographic Restrictions. The Services are intended for global use. However, some jurisdictions may impose restrictions on use of AI technologies, career platforms, or data processing. JobWinner reserves the right to restrict access in territories where use would contravene applicable law.
3.4 Institutional Users. Universities, bootcamps, employers, or other entities purchasing a White-Label Solution or group subscription must ensure that all end-users within their organisation comply with these Terms.
4. User Accounts and Registration
4.1 Eligibility and Organization Affiliation
To access and use the Services, you must create a User Account associated with your Organization. Registration is only permitted if your Organization has granted you access to JobWinner. Users who are not affiliated with an Organization must use the separate Terms of Service applicable to personal subscriptions.
4.2 Registration Requirements
You must provide accurate, complete, and up-to-date information during registration. Your Account is personal to you and may not be shared with any other individual.
4.3 Login and Authentication Methods
Registration may occur through your Organization’s Single Sign-On (SSO) system or through approved third-party login providers. By using these login methods, you authorize JobWinner to access the information necessary to create and manage your Account.
4.4 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your Account. You must notify JobWinner immediately of any unauthorized use.
4.5 Suspension or Termination of Accounts
JobWinner reserves the right to suspend or terminate your Account at its discretion if inaccurate information is provided, if your Organization withdraws your access, or if you violate these Terms.
4.6 End of Organization-Provided Access
Access provided by an Organization may end when your affiliation with the Organization ends.
If your Organization’s agreement with JobWinner terminates, your access to the Services may also terminate or be modified.
4.7 Acceptance of Terms
You may only complete registration if you accept these Terms. If you do not agree to these Terms, you are not permitted to create an Account or use the Platform.
5. Data Protection and Privacy
5.1 Compliance
JobWinner complies with the General Data Protection Regulation (EU) 2016/679 (GDPR) and other applicable data protection laws.
5.2 Data Collection
We process personal data such as account details, résumés, job descriptions, usage activity, and analytics. For Organization users, additional usage data may be collected.
5.3 User Rights
Users have the right to access, rectify, erase, restrict processing, and export their personal data. Requests can be submitted to support@jobwinner.ai.
5.4 Data Retention
We retain data only for as long as needed to provide the Services or as required by law or the Organization’s agreement.
5.5 Third-Party Processors
Some processing is performed by authorized subprocessors (e.g., hosting, authentication, analytics), all bound by GDPR-compliant agreements.

6. Acceptable Use
6.1 Lawful and Permitted Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not use the Platform in any way that violates applicable law, infringes third-party rights, or breaches institutional policies.
6.2 Authenticity and Identity
You must provide accurate and truthful information when using the Platform. Impersonation, use of false identities, or misrepresentation of your affiliation with an Organization is strictly prohibited.
6.3 Rights to Uploaded Content
You may upload documents or content only if you own them or have all necessary rights and permissions to use them on the Platform. You agree not to upload copyrighted, confidential, or proprietary materials without authorization.
By uploading or generating content, you grant JobWinner a limited license to process, transform, and analyze such content solely for the purpose of providing the Services.
6.4 Technical Integrity of the Platform
You may not:
– Attempt to gain unauthorized access to data, accounts, or areas of the Platform;
– Interfere with, disrupt, or damage the operation of the Platform or its infrastructure;
– Attempt to reverse-engineer, copy, or replicate any part of the Platform;
– Circumvent technical restrictions, access controls, or security measures.
6.5 Harmful or Inappropriate Content
You may not create, upload, or share content that is harmful, malicious, fraudulent, abusive, harassing, discriminatory, or otherwise inappropriate.
JobWinner may remove or restrict access to any content that violates these Terms, violates the law, or is requested to be removed by the Organization or a third party.
6.6 Malware and Security Risks
You may not upload files that contain viruses, malware, corrupted data, or any harmful code intended to disrupt systems or compromise security.
6.7 Inactivity and Access Management
JobWinner may deactivate or restrict Accounts that remain inactive for extended periods or where continued access is not required by the Organization. When reasonable, Users will be notified in advance before deactivation.
6.8 Enforcement and Suspension
JobWinner may suspend or terminate your access if you violate these Terms, engage in misuse, upload unlawful content, or compromise the security or integrity of the Platform. Organizations may also request suspension or removal of Users under their administrative control.
7. Suspension and Termination
7.1 User-Initiated Deletion
You may delete your Account at any time through your profile settings or by contacting support@jobwinner.ai. Certain data may be retained where legally required.
7.2 End of Organization-Provided Access
If your access is provided by an Organization, it may end automatically when your affiliation ends or if the Organization requests deactivation.
7.3 Termination by JobWinner
JobWinner may suspend or terminate your Account if you violate these Terms, upload harmful or unlawful content, misuse the Platform, pose security risks, or provide false information.
7.4 Inactive Accounts
JobWinner may deactivate Accounts that remain inactive for extended periods. When reasonable, notice will be provided in advance.
7.5 Consequences of Termination
Once your Account is terminated, your right to use the Platform ends immediately. You may request export of your personal data as described in the Privacy Policy. Certain obligations (e.g., intellectual property, liability) will continue to apply.
8. Disclaimers and Limitation of Liability
8.1 “As Is” Basis. Services are provided on an “as is” and “as available” basis, without warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2 AI-Generated Content Disclaimer. The Services include AI-powered tools for résumé tailoring, cover letter writing, and interview preparation. Users acknowledge that such content is generated automatically, may contain errors, and should be reviewed before use. JobWinner does not guarantee employment outcomes.
8.3 Third-Party Links. The Platform may include links to third-party websites. JobWinner is not responsible for their availability, accuracy, or practices.
8.4 Limitation of Liability. To the maximum extent permitted by law, JobWinner shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, reputational harm, lost opportunities, or business interruption.
8.5 Cap on Liability. JobWinner’s total aggregate liability arising out of these Terms shall not exceed the total fees paid by the User in the six (6) months preceding the claim.
9. Applicable Law and Jurisdiction
9.1 Applicable Law
These Terms are governed by the laws of Ireland, without regard to conflict-of-law principles.
9.2 Jurisdiction
If the User is a business entity, public institution, or Organization using JobWinner under a service agreement, the exclusive place of jurisdiction for all disputes arising from these Terms is Dublin, Ireland.
However, JobWinner may also bring legal action in the jurisdiction where the Organization is registered or operates.
10. Changes to These Terms
10.1 Right to Modify Terms
JobWinner may update or modify these Terms during the contractual relationship with the User. Users will be informed of changes in an appropriate manner, usually through the Platform or by email. Updated provisions will be clearly identified.
10.2 Acceptance of Changes
If the User continues to use the Platform after the updated Terms have been communicated and made available, this constitutes acceptance of the new version. Users will be informed of the significance of continued use.
10.3 Objection to Changes
If the User objects to the changes, JobWinner may terminate the User’s access to the Platform at the time the updated Terms are intended to take effect.
11. Rights to the Platform
11.1 Intellectual Property
All intellectual property rights in the Platform — including software, features, AI systems, design elements, text, graphics, trademarks, service marks, logos, and other proprietary content — belong exclusively to JobWinner Ventures Limited or its licensors. No part of the Platform may be copied, reproduced, distributed, modified, displayed, or used without JobWinner’s prior written consent.
11.2 No Transfer of Rights
No ownership rights or licenses are granted to the User except for the limited right to access and use the Platform in accordance with these Terms.
12. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force. The invalid provision will be replaced by the applicable legal rule closest to its original intent.
